SALE METHOD: Hiner Real Estate & Auction will offer this property at public auction on February 3, 2026. At 6:00 PM, 367+/- acres in 10 Tracts will be offered at the Huntington Co. 4-H Fairgrounds, Heritage Hall building located at 631 E. Taylor St, Huntington, IN 46750. This property will be offered in 10 individual tracts. Tracts 1-9 will be sold on a price per acre basis and will be offered through the marketing method of “Buyer’s Choice”, whereas the high bidder can elect any, or all, of the tracts for their high bid. After Tracts 1-9 have been elected and removed from the Buyers Choice bidding pool, Tract 10, the house and buildings, will be offered per a lump sum basis (total dollars). The tracts will NOT be offered as a whole, nor in any combination, at the conclusion of the auction.
ACCEPTANCE OF BID PRICES: Successful bidder(s) will be required to enter into a purchase agreement at the auction site immediately following the close of the auction. Successful bidders must execute purchase agreements on tracts exactly as they have been bid. If a bidder is awarded multiple tracts, such tracts will not be split in separate purchase agreements at the close of the auction. All final bid prices are subject to the Seller's acceptance or rejection.
DOWN PAYMENT: 10% of the accepted bid down on the day of the auction with the balance due at closing. The down payment must be in the form of cash, cashier’s check, personal check, or corporate check. Your bidding is not conditional upon financing, so be sure you have arranged financing, if needed and are capable of paying cash at closing.
ACREAGE: All tract acreages, dimensions, and proposed boundaries are approximate and have been estimated based on current legal descriptions and/or aerial photos. These images and drawings are for illustration purposes only and are not surveyed boundary lines.
CLOSING: The closing shall be on or before March 27, 2026. The Sellers have the choice to extend this date if necessary. The balance of the real estate purchase price is due at closing.
POSSESSION: Possession at closing.
PERSONAL PROPERTY: Any personal property, including the LP tank, on Tract 10 is NOT included in the sale of real estate. Buyer(s) agrees to acquire the purchased tract with remaining or discarded personal property or debris. Seller shall have no obligation before or after closing to remove items or clean up any part of property.
REAL ESTATE TAXES: Seller will pay 2025 taxes payable spring 2026. Buyer will be a given a credit at closing for the 2025 real estate taxes due in 2026 and will pay all taxes beginning with spring 2026 installment and thereafter.
EVIDENCE OF TITLE: Seller shall provide a title insurance policy in the amount of the purchase price.
DEED: The Sellers will provide a Warranty Deed at closing.
SURVEY: The Seller shall provide a new survey where there is no existing legal description or where new boundaries are created by the tract divisions in this auction. Any need for a new survey shall be determined solely by the Seller. Seller and successful bidder shall each pay half (50:50) of the cost of the survey. The type of survey performed shall be at the Seller's option and sufficient for providing title insurance. Adjoining tracts purchased by the same bidder will receive a perimeter survey only. Closing prices will be adjusted to reflect any differences between advertised and surveyed acreages.
DITCH ASSESSMENT: The Buyer(s) will pay 2026 ditch assessments, if any.
ZONING AND EASEMENTS: Property is being sold subject to all easements of record.
MINERAL RIGHTS: The sale shall include 100% of the mineral rights owned by the Seller.
PROPERTY INSPECTION: Each potential Bidder is responsible for conducting, at their own risk, their own independent inspections, investigations, inquiries, and due diligence concerning the property. Inspection dates have been scheduled and will be staffed with auction personnel. Further, Seller disclaims all responsibility for Bidder's safety during any physical inspection of the property. No party shall be deemed an invitee of the property by virtue of the offering of the property for sale.
OPEN HOUSES: An open house for Tract 10, the house and buildings, is Wednesday January 21, 2026, from 3pm-5pm.
